Unequal Application of the Marital Presumption of Parentage for Same-Sex Parents

Center for American Progress logoBy recognizing marriage equality nationwide, the Obergefell decision suggested in part the message that love makes a family resonated with both the public and the U.S. Supreme Court. Yet the decision itself did not fully address the many additional elements of family law beyond who one can marry. Even when same-sex couples get married and establish households that more closely mirror a so-called traditional family, they still encounter roadblocks to forming and legally protecting that family. One such roadblock is the unequal application of the “marital presumption of parentage.”

Traditionally applied to the husband of a wife who gives birth, the marital presumption of parentage—also called the marital presumption of legitimacy—assumes that children born to a married couple are products of that marriage and recognizes both members of the couple as parents. This presumption exists in some form in every state but historically could be rebutted by evidence proving that it was impossible for the person who did not give birth to be a biological parent of the child. BREAKING: Trump Administration Pushes to Advance Wardlow’s Discrimination Case to U.S. Supreme Court

The Trump Administration is asking the U.S. Supreme Court to uphold a case Doug Wardlow originally argued, to allow LGBTQ people to be fired for who they are

MINNESOTA – Yesterday, the Trump Administration asked the United States Supreme Court to take up a case and rule that businesses can discriminate against workers based on their gender identity without violating federal law. The case the Trump Administration is asking the Court to consider was originally argued by Doug Wardlow on behalf of the Alliance Defending Freedom, an anti-LGBTQ hate group, to uphold the discriminatory firing of a funeral home employee in Michigan.

Meet Doug Wardlow

The Republican candidate running for the State Attorney General position, Doug Wardlow, doesn’t have a lot of name recognition.  He does have a long history of positions opposed to those of the majority of Minnesotans.  He recently scrubbed his Twitter feed, but people captured it before he tried to clean up his past.

Trump Admin To Transgender Kids: We Won’t Deal With Your Civil Rights Complaints

Exclusive: Transgender students are filing discrimination complaints with the Office for Civil Rights, but the office says these issues fall outside its purview.

In Texas, a transgender teenager said his high school discriminated against him for almost two years. He was not allowed to use the bathroom that corresponded with his gender identity. When he traveled overnight with one of the school’s teams, he wasn’t allowed to room with his male peers, he alleged.

But Donald Trump’s Department of Education did not think it could help this student.

The teenager’s case is one of at least three involving transgender students’ experiences navigating school bathrooms or gender-specific sports teams that the Department of Education’s Office for Civil Rights has dismissed in the past several months, with the explanation that these issues do not fall under its jurisdiction, according to documents obtained by HuffPost and a source familiar with the matter.

The Trump administration’s view of these cases diverges sharply from that of the Obama administration, which contended that Title IX ― the federal law that deals with sex discrimination ― included discrimination based on gender identity. The Obama administration issued guidance holding that schools should allow students to use the facilities that align with their gender identity.

n DeVos won’t say whether she’d withhold federal funds from private schools that discriminate

The following article by Emma Brown was posted on the Washington Post website May 24, 2017:

Education Secretary Betsy DeVos refused to say Wednesday whether she would block private schools that discriminate against LGBT students from receiving federal dollars, explaining that she believes states should have the flexibility to design voucher programs and that parents should be able to choose schools that best fit their children’s needs.

Five startling things Betsy DeVos just told Congress

The following article by Valerie Strauss was posted on the Washington Post website May 24, 2017:

Does this sound familiar? Betsy DeVos went to Capitol Hill to testify before U.S. lawmakers. She didn’t answer a lot of direct questions and engaged in some contentious debates with some members.

That happened in January when she went before the Senate education committee for her confirmation hearing, during which she said schools needed guns to protect against grizzly bears. This time, the education secretary didn’t talk about guns, but she did say that states should have the right to decide whether private schools that accept publicly funded voucher students should be allowed to discriminate against students for whatever reason they want. ‘One word says it all. Asian’: Airbnb host reportedly leaves guest stranded because of her race

An Airbnb host in California has been banned after an Asian American guest claimed her reservation was canceled at the last minute because of her race.

Airbnb spokesman Nick Papas told The Washington Post in an email that the host’s behavior was “abhorrent and unacceptable.” The company has in recent years faced growing complaints of racial discrimination by its hosts. New Religious Freedom Bills Legitimize Discrimination

150626103125-supreme-court-same-sex-marriage-1024x576You’d think history might serve as a guide for the politicians and preachers — good Christians all, of course — who have chosen to use the Bible to bolster their bigotry against people they’ve placed outside the magic circle. We’ve seen this before, and it didn’t turn out well for those who claimed a mantle of righteousness. Yet onward they march.

Mississippi recently passed a “religious freedom” law designed to provide legal cover for those who wish to discriminate against gays and lesbians. The law is quite specific, allowing government clerks to refuse to issue marriage licenses to same-sex couples and protecting businesses that refuse to serve them.
