Rep. Mo Brooks may be done with Jan. 6, but Jan. 6 isn’t done with him.

The Alabama representative, notorious for his speaking role at the Jan. 6 rally leading up to the invasion of the Capitol, did not watch Tuesday’s first hearing of the House select committee investigating said invasion.

“I was in the House Armed Services Committee, Science, Space, Technology Committee, and had at least one Zoom meeting, and all sorts of other things,” he told me Wednesday when I encountered him outside the House chamber. “Busy day.” Not that a clear schedule would have made a difference. A Republican congressman’s Jan. 6 speech at a rally ahead of the riot at the U.S. Capitol is not covered by protections for members of Congress and federal employees, the Justice Department said in a court filing Tuesday — drawing a legal line over attempts to stop the certification of the 2020 election results.

Rep. Mo Brooks (R-Ala.) had argued that he is effectively immune from a lawsuit filed by his colleague Rep. Eric Swalwell (D-Calif.) that accused Brooks, then-President Donald Trump, and others of fomenting the failed attack on Congress.

Past court opinions and Justice Department legal interpretations have given broad safeguards to protect elected officials who are sued over their public statements. But in the case of Brooks, the Justice Department decided he went too far. Continue reading.

DOJ rejects Mo Brooks defense, says his Jan. 6 speech not part of duties

The U.S. Department of Justice, in a court filing Tuesday, rejected Mo Brooks’ defense that his fiery speech at the pro-Trump rally hours before the former president’s supporters stormed the Capitol was part of his duties as a congressman.

The DOJ agreed with an opinion from the House Administration Committee that House rules said such actions were not within the scope of his office, as Brooks had argued in a court affidavit last month.

In that affidavit, Brooks asserted the Westfall Act as protection for his actions at the rally – which protects federal employees from legal action when acting within the scope of their office. The DOJ filing concludes with, “The United States respectfully requests that Brooks’ petition for a Westfall Act certification be denied.” Continue reading.

Mo Brooks Pays $25K To Trump Resort After Former Guy Endorses Senate Bid

Rep. Mo Brooks (R-AL), who is currently a candidate for Alabama’s U.S. Senate seat, paid out over $25,000 to former President Donald Trump’s Mar-a-Lago resort just days after receiving an endorsement from Trump.

Brooks is running for the seat being vacated by Sen. Richard Shelby, who has announced he will not run for reelection in 2022. The seat has been rated as “solid” for the Republican Party by multiple political ratings organizations.

On Thursday, in a federal campaign finance filing, Brooks’ campaign disclosed that it had paidover $25,000 to Mar-a-Lago for catering and event space. Shelby held a fundraiser at Mar-a-Lago on April 23 and Trump, who currently lives at the resort after losing the presidential election, was scheduled to be in attendance. Rep. Mo Brooks (R-AL), who was one of the very first leaders of Donald Trump‘s January 6 insurrection, on Friday urged GOP voters at a conservative conference to fight and die for America, just like George Washington’s soldiers did at Valley Forge, and telegraphing to them their very “survival” is at stake.

Brooks was the first member of Congress to declare he would vote against certifying the results of the Electoral College and vote to overturn the free and fair presidential election. On January 6 he also delivered a speech, telling Trump supporters at the Trump-financedTrump-produced, and Trump-promoted rally prior to the violent attack on the Capitol, “Today is the day American patriots start taking down names and kicking ass.”

On Friday Brooks told attendees at CPAC, the Conservative Political Action Conference, that the “choice is simple: We can surrender and submit. Or we can fight back, as our ancestors have done.” Continue reading.

Rep. Mo Brooks (R-AL) claims in a new court filing that he was asked by a White House official to speak at former president Donald Trump’s infamous “Stop the Steal” rally that preceded the Jan. 6 insurrection.

The Alabama Republican was given Trump’s endorsement for the U.S. Senate after making the speech, which a lawsuit alleges helped incite the violent assault on the U.S. Capitol, but Brooks’ attorneys responded by insisting he only took part because the former president wanted him there.

“Brooks only gave the Ellipse Speech because the White House asked him to, in his capacity as a United States Congressman,” the new court filing says. “But for the White House request, Brooks would not have appeared at the Ellipse Rally.” Continue reading.

GOP Congressman: FBI ‘participated’ in insurrection to ‘entrap’ harmless protestors and ‘frame the MAGA movement’

U.S. Rep. Louie Gohmert (R-TX) is demanding the Federal Bureau of Investigation and the Dept. of Justice tell Congress what they know about their own alleged “participation” in Donald Trump’s January 6 insurrection, which led to at least seven deaths. Gohmert falsely claims the attack on the U.S. Capitol – which in reality was an attempted coup designed to overturn a free and fair election – was instead a “monumental entrapment scheme used as a pretext to imprison otherwise harmless protestors” and used to “frame the entire MAGA movement as potential domestic terrorists.”

News organization The Recount calls Gohmert’s assertions “a bullshit baseless conspiracy theory.”

The Texas Republican congressman, explained on Thursday on the floor of the House that his “friend,” Fox News white supremacist host Tucker Carlson “covered this last night,” called the conspiracy theory “really disturbing… because we don’t like to see government agents stirring up trouble or find that there are criminal acts that would not likely have occurred had not the federal government been participating.” Continue reading.

Brooks’s claim that counting the votes of ‘eligible American citizens’ would have reelected Trump

Donald Trump won the presidential race “if only lawful votes cast by eligible American citizens were counted … Somewhere in the neighborhood of 900,000 to 1.7 million noncitizens voted in the 2020 presidential election overwhelmingly for Joe Biden.”

Brooks, who is running for the Senate, is echoing Trump’s false claim that President Biden actually lost the election. He, like Trump, claims there was all sorts of election fraud behind Biden’s victory. But he also has argued that Biden’s victory was greased by the votes of noncitizens.

The Examiner said that Brooks “did not provide evidence to support the claim” but instead pointed to a speech he made on Jan. 7 that laid out his calculations. In the address on the House floor, he declared: “Noncitizens overwhelmingly voted for Joe Biden in exchange for the promised amnesty and citizenship and, in so doing, helped steal the election from Donald Trump, Republican candidates, and American citizens all across America.”

The speech is actually rather detailed in showing Brooks’s math. But it relies on dubious assertions, some of which we have fact-checked before, to come up with these numbers. Continue reading.

Rep. Mo Brooks (R-AL) has refused to be served in a lawsuit over his role in inciting the Jan. 6 attack on the U.S. Capitol, according to an attorney for Rep. Eric Swalwell (D-CA).

The California Democrat has sued President Donald Trump, Donald Trump Jr. and Rudy Giuliani for their own roles in the Capitol insurrection, and the complaint also alleges that Brooks incited the riot with his speech ahead of the violent assault on the democratic process, reported Axios.

“We have been attempting to serve our complaint on Mo Brooks for more than a month,” Swalwell attorney Philip Andonian told Punchbowl News. Continue reading.
